I don't think there's a wall in which oil becomes totally useless. It should be fine.
Your biggest advantage was hitting the gas from behind and gaining speed before he could react.
Are you refering to the exhaust servo? The servo in the airbox activates a valve in the exhaust. If you have the stock exhaust, you won't want to remove that.
